On august 4, 2011, the Ministry of Health completely revised ‘"The Child Welfare Act’"(enforced 08.05.2012, Law No.11002) specifically expanding guarantees and protections of the rights of children. The new law focused founding and supplementing particularly on child abuse. Meanwhile, the problem of child abuse in our society has not garnered much attention except for the problem of sexual abuse, and child abuse becomes more problematic when parents are in a economically difficult situation. Moreover, child abuse is still treated as a problem with in the family. Not worthy of much social attention, whereas these are many laws to help the underprivileged. Under these circumstances, the revision of ‘"The Child Welfare Act’" is very desirable. In particular, although this law is inferior to requiring establishment of ‘"The Child Abuse Prevention Act’" in separate way through several papers and books I wrote, this is very meaningful because part of the suggested contents as the improvement method for effective prevention of child abuse and protection of the abused child were reflected. However, in this revision, while treating the child abuse problem as part of the child welfare, this law still partially deals with the problem of service about the abused child with context like overall child in need of public assistance. Also, contents about prevention, detection, processing, and post-processing, of child abuse are too incomplete, so the law is of limited use in dealing with child abuse. As a result, in this paper, we will analyze current regulations about child abuse of this law, and its problems and improvement methods will be discussed by focusing on the regulation’"s contents.
