The existing Employment Insurance Act is an important law dealing with a social risk i.e. unemployment while covering maternity protection such as maternity leave benefit and parental leave. The Employment Insurance Act is applied to employees in principle, but exceptionally applied to those who are not employees but need to be protected against social risks to be dealt by the Employment Insurance. Even such persons, however, are excluded from the application when they are covered by laws other than the Employment Insurance Act so the goal of employment insurace system is achieved, application of the system is inevitably difficult, or it is not desirable to apply the system considering the purpose of implementation of the system, that is, there is wide range not covered by the system. This paper insists, those employees who are not covered by the Employment Insurance Act because of being employed or selfemployed after age of 65 or short-time employees working less than 15 hours per week should be covered by the Act as well. And this paper insists that persons in special types of employment such as platform worker who are currently not employees but need to be protected just like employees and domestic workers not covered by labor laws such as the Employment Insurance Act should be covered by the Act.
